What regulations does an HOA have?

If you want to run a homeowners association (HOA), you know that you get to put rules and regulations on the community. An HOA is responsible for collecting dues, providing services and setting up rules for how people will live within that neighborhood.

But what types of rules can you actually use? How much are you allowed to dictate how people will live in the HOA? Every case is unique, but below are some common examples.

Who uses the home?

First of all, the HOA may specify that the home can’t be rented out. The owners have to live there. This is especially common with the rise of Airbnb, and an HOA may say that the home cannot be rented out even on a short-term basis.

Property presentation

HOAs are often concerned with the way that the property looks and the aesthetic appeal of the neighborhood. They may have rules about where vehicles can be parked, for instance, or how often landscaping and grass-cutting have to be done. They can even specify what colors can be used when repainting a home or how additions and modifications can be made. Holiday decorations are also a common area to address.

Noise violations

Additionally, an HOA may state that certain noise violations are not allowed. This is not exclusive just to HOAs. Many cities already have rules like this in place. But the HOA can define exactly when the residents want these restrictions to take place and how they should be applied.
